What to Do After a Car Accident in South Florida
A car accident in South Florida can happen in seconds, but the decisions you make in the minutes, hours, and days afterward can determine whether you receive full compensation for your injuries and losses. South Florida — including Broward, Miami-Dade, Palm Beach, and Monroe counties — consistently ranks among the most dangerous regions in the United States for motor vehicle accidents. Stewart Valencia P.A. is a Fort Lauderdale personal injury law firm representing accident victims throughout South Florida. Attorney Stewart Valencia has 28+ years of litigation experience and 100+ trials to verdict. Call (954) 767-7020 for a free consultation.
What to Do Immediately After a Car Accident in South Florida
1. Check for Injuries and Call 911
Your safety comes first. Check yourself and passengers for injuries. Call 911 immediately — even if injuries seem minor. Florida law requires you to report accidents involving injury, death, or property damage over $500. A police report creates an official record that is critical for your insurance and personal injury claim.
2. Do Not Leave the Scene
Under Florida law (F.S. §316.061), leaving the scene of an accident involving injury or death is a felony. Even in accidents with only property damage, you must remain until exchanging information is complete. Stay calm and do not admit fault — even a casual "I'm sorry" can be used against you later.
3. Exchange Information and Document the Scene
Exchange with all involved drivers: full name and contact information, driver's license number, vehicle registration, insurance company and policy number, and license plate. Photograph all vehicles, road conditions, traffic signals, skid marks, injuries, and any relevant signage. Get contact information from all witnesses before they leave.
4. Seek Medical Attention Immediately — Even If You Feel Fine
This is critical for two reasons. First, injuries like whiplash, concussions, and internal bleeding may not produce immediate symptoms. Second, Florida's Personal Injury Protection (PIP) insurance requires you to seek medical treatment within 14 days of the accident to receive benefits. Gaps in medical care are the single most common reason insurance companies reduce or deny personal injury claims.
5. Report the Accident to Your Insurance Company
Notify your insurance company promptly. However, do not give a recorded statement to the other driver's insurance company without first speaking to an attorney. Insurance adjusters are trained to minimize payouts, and your statements can be used to reduce your claim.
6. Understand Florida's No-Fault Insurance and PIP
Florida is a "no-fault" state, meaning your own Personal Injury Protection (PIP) insurance covers your medical bills and lost wages up to $10,000, regardless of who caused the accident. However, to step outside the no-fault system and pursue a claim against the at-fault driver, your injuries must meet Florida's "serious injury" threshold — including significant and permanent loss of an important bodily function, permanent injury, significant scarring, or death.
7. Do Not Accept a Quick Settlement
Insurance companies often contact accident victims quickly with a settlement offer. These initial offers are almost always far below the true value of the case. Once you sign a release, you waive all future claims — even if your injuries worsen or require additional surgery. Consult an attorney before signing anything.
8. Florida's Statute of Limitations for Car Accident Claims
Under Florida law (modified in 2023), the statute of limitations for personal injury claims is generally two years from the date of the accident. Acting quickly preserves evidence, witness memories, and your legal rights. Contact Stewart Valencia P.A. at (954) 767-7020 as soon as possible after your accident.
